1、摘要摘要殘疾,作為人類自身發(fā)展必須要付出的代價,伴隨著人類歷史走過了幾百萬年。殘疾人,作為在心理、生理、人體結(jié)構(gòu)上,某種組織、功能喪失或者不正常,全部或者部分喪失以正常方式從事某種活動能力的個體,處在社會生活的底層,其生活條件和狀況十分低下。要改變殘疾人和生存狀況和條件,使殘疾人與健全人一道共享物質(zhì)文明、精神文明和社會文明的發(fā)展成果,離不開勞動就業(yè)。作為民生之本,就業(yè)能夠從根本上改變或改善殘疾人的生存環(huán)境,從而提高他們的生活質(zhì)量,增強他們的幸福感。但是,目前,殘疾人的就業(yè)狀況并不理想,還存在著這樣那樣的困難和問題。還需要國家、企業(yè)和全社會共同努力來縮小殘疾人與健全人之間的差距
2、,不斷創(chuàng)造就業(yè)條件,保障他們的就業(yè)權(quán)利,滿足他們勞動就業(yè)、過上更美好生活的愿望和訴求。本文試圖結(jié)合當(dāng)前中國殘疾人勞動就業(yè)的現(xiàn)狀,指出保障殘疾人勞動就業(yè)權(quán)的實現(xiàn)是從法律中形式平等的勞動就業(yè)權(quán)走向?qū)嵸|(zhì)平等就業(yè)權(quán)的關(guān)鍵。同時,筆者將從國家和企業(yè)兩大層面來分析探討實現(xiàn)殘疾人勞動就業(yè)權(quán)利保障的有效路徑,并重點探討為什么企業(yè)在它的社會責(zé)任與利潤的最大化的矛盾之中還要確保殘疾人勞動就業(yè)以及如何確保殘疾人勞動就業(yè)權(quán)的實現(xiàn)。關(guān)鍵詞:殘疾人勞動就業(yè)保障AbstractDisability,self-developmentashumanbeingshavetopaytheprice,alongwi
