2、rprisepatent企業(yè)專利戰(zhàn)略是經(jīng)營(yíng)戰(zhàn)略的重要一環(huán)Enterprisepatentstrategiesshallrefertooneimportantprocedureofitsbusinessstrategies事件的經(jīng)過(guò)Process:早在70年代，經(jīng)營(yíng)建筑、航天業(yè)的美國(guó)Honeywell公司，對(duì)微電子應(yīng)用產(chǎn)生了濃厚的興趣，并在自動(dòng)聚焦領(lǐng)域開(kāi)花結(jié)果。自1975至1977年間獲得美國(guó)四項(xiàng)專利，即美國(guó)第3806935,3875401,4002899專利及29,599號(hào)再發(fā)行專利。其有效期滿日期為1992~1994年

4、4002899patentsandN.29,599re-publicationpatent.Thevalidityis1992-1994.1979年Honeywell公司就自動(dòng)聚焦技術(shù)召集世界主要照相機(jī)廠家召開(kāi)了技術(shù)公開(kāi)會(huì)，締結(jié)所謂“技術(shù)公開(kāi)協(xié)議”(advancedisclosureagreement)，日本的Minoulta與會(huì)并簽了字，還花了8萬(wàn)5千美元買了Honeywell公開(kāi)的有關(guān)技術(shù)資料。其微型組件不久將公開(kāi)銷售。當(dāng)時(shí)，Honeywell公司要求各廠家把該組件作為標(biāo)準(zhǔn)件用于各廠家的照相機(jī)上，并由Honeywel
5、l提供這種組件。In1979,Honeywellhassummonedmainworldcameramanufacturersandheldapublictechnologicalconferenceconcerningautomaticfocustechnologytoreachtheso-calledadvancedisclosureagreement.JapaneseMinoultahasattendedtheconferenceandpressedthesignatureandspent85,000USDtopu
6、rchaserelevanttechnicalmaterialspublishedbyHoneywell.Themicroscopiccomponentswillbesoldinthenearfuture.Atthatmoment,Honeywellhasaskedvariousmanufacturerstoadoptthecomponentsinthecamerasofvariousmanufacturersasthestandardparts.Honeywellshallberesponsibleforprovidi
7、ngthesecomponents.經(jīng)研究，Minoulta公司認(rèn)為Honeywell公司的組件有缺陷，決定獨(dú)自開(kāi)發(fā)自動(dòng)聚焦系統(tǒng)，并通知Honeywell公司。因此Honeywell公司特別指出，Minoulta公司不得將該組件用于其照相機(jī)上，且不得將得到的技術(shù)資料用于不正當(dāng)?shù)哪康?。Uponresearch,MinoultaheldthatthecomponentsofHoneywellsufferfromdefects.Itthusdecidedtodeveloptheautomaticfocussystembyits
