1、2001年國際燃油污染損害民事責任公約五摘要：本文主要介紹了在1994年IMO海洋環(huán)境保護委員會(MEPC)第三十八屆會議上，澳洲提議MEPC發(fā)展國際燃油污染損害賠償機制。MEPC隨后請TM0法律委員會考慮，法律委員會于稍后的1995年第七十三屆會議組成工作小組討論此課題。實際上在1996年H7S公約起草階段，IMO法律委員會曾建議將燃油污染納入該公約，但因許多國家主張燃油污染應獨立立法，而使燃油污染未被納入1996年HNS公約架構之下的2001年國際燃油污染損害民事責任公約。3.(a)AStatePartyma
2、yauthorizeeitheraninstitutionoranorganizeitionrecognizedbyittoissuethecertificatereferredtoinparagraph2.SuchinstitutionororganizationshallinformthatStateoftheissueofeachcertifiedte.Tnal1cases,theStatePartyshal1fullyguaranteethecompletenessandaccuracyofthecert
3、ificatesoissuedandshallundertaketoensurethenecessaryarrangementstosatisfythisobligation.(b)AStatePartyshallnotifytheSecretary-Generalof:(i)thespecificresponsibilitiesemdconditionsoftheauthoritydelegatedtoaninstitutionororganizationrecognisedbyit;(ii)thewithdr
4、awalofsuchauthority;and(i)thedatefromwhichsuchauthorityorwithdrawalofsuchauthoritytakeseffect.Anauthoritydelegatedshal1nottakeeffectpriortothreemonthsfromthedateonwhichnotificationtothateffectwasgiventotheSecretary-General.(c)Theinstitutionororganizationautho
5、r!zedtoissuecertificatesinaccordancewiththisparagraphshall,asaminimum,beauthorizedtowithdrawthesecertificatesiftheconditionsunderwhichtheyhavebeenissuedarcnotmaintaincd>InallcasestheinstitutionororganizationshallreportsuchwithdrawaltotheStateonwhosebehalfthec
