2、herwiseknownastheBroadcastingTreaty.ThisreporthasbeendraftedasaninitialresponsetothatdrafttreatyandtheintendedaudienceisgroupswhoarealreadyfamiliarwiththedebateconcerningtheBroadcastTreaty.Thereportdealswithfourkeyareas.First,itarguesthattheover-propertizationofbroadcastrightsthroughthetreatymayle
3、adtoatragedyoftheanticommons,ortheunder-useoftheresourcesinquestion.Second,thereportshowsthatcontrarytotheimpressioncreatedbytheDraftTreaty,manyoftheproposalsforthenewtreatyareinfactsignificantchangesfromtheexistingtreatyregime.Ofparticularconcernistheextensionoftermto50years,aperiodthatishardlyju
4、stifiableasnecessaryforbroadcastersinordertorecouptheirinvestment.Third,thereportarguesbyanalogytothestrugglestocreateaworkabledatabaserightthatcloseconsiderationmustbegiventoproposalstoextendthescopeandtermofrightsbroadcastrightsthatareprotectedbyotherregimes.Finally,thereportinterrogatesthestrat
5、egyofusingWIPOastheforumforthenegotiationofthistreatygivenitsconstitutionalmandatetopromoteintellectualproperty,itsfundingstructureanditslimitedmeansforengagingbroaderstakeholdersinpolicydevelopment.B.Potentialanticommonsproperty?Thethrustoftheproposedtreatyliesinthecreationofanew‘broadcastingrigh
