1、BT模式下工期延誤索賠問(wèn)題研究隨著我國(guó)基礎(chǔ)設(shè)施建設(shè)的需求不斷增大，岀現(xiàn)了諸多的非政府經(jīng)濟(jì)參與基礎(chǔ)設(shè)施建設(shè)的融資方式，BT模式則是其中較具代表性的一種新型投融資模式，并且在我國(guó)日益受到重視。由于BT模式涉及參與主體眾多，且其間關(guān)系復(fù)雜，致使其投資控制成為影響該類(lèi)項(xiàng)目實(shí)施效果的關(guān)鍵。BT項(xiàng)目投資控制的關(guān)鍵影響因素之一即工期延誤引起的索賠，它不但導(dǎo)致工程建設(shè)費(fèi)用增加，而且致使建設(shè)周期增長(zhǎng)，延誤發(fā)起人的回購(gòu)時(shí)間，從而增加BT項(xiàng)目的融資費(fèi)用，影響基礎(chǔ)設(shè)施建設(shè)項(xiàng)目的經(jīng)濟(jì)效益和社會(huì)效益。因此，本文對(duì)BT模式下工期延誤引起的索
2、賠問(wèn)題進(jìn)行了研究。1.BT項(xiàng)目?jī)蓪雍贤P(guān)系的分析。理清BT項(xiàng)目參與各方的關(guān)系,并分解出BT項(xiàng)目中的兩層合同關(guān)系，即BT投資建設(shè)合同與施工承包合同,前者是BT項(xiàng)目所特有的合同關(guān)系，而后者則是一般承發(fā)包合同，本文分別選擇了這兩層合同關(guān)系的代表性合同文件進(jìn)行了對(duì)比。2.不同合同條件中工期延誤的歸責(zé)問(wèn)題分析。在合同中進(jìn)行明確、合理地歸責(zé)是減少工期延誤索賠的重要途徑，本文運(yùn)用魚(yú)刺圖法對(duì)工期延誤的誘因進(jìn)行了分析，并通過(guò)對(duì)比分析合同條款得出不同合同條件中工期延誤認(rèn)定和歸責(zé)的相關(guān)規(guī)定，以及BT合同與通用合同在此方面的異同。3.
