1、檢測分析計畫合約書TestingandAnalysisContract立合約書人（以下簡稱甲方）義守大學（以下簡稱乙方）ThisContractisenteredintobetween(hereinafterreferredtoasPartyA)andI-SHOUUNIVERSITY(hereinafterreferredtoasPartyB).茲因甲方委託乙方執(zhí)行檢測分析計畫（以下簡稱本計畫），雙方協(xié)議如下，以茲共同遵守：WHEREASPartyAentrustsPartyBwithatestingandanalysisproject(here
2、inafterreferredtoas“theProject”),bothpartiesmutuallyagreeasfollows,asasignofmutualrespect:第一條服務內容乙方受甲方委託執(zhí)行本計畫，本計畫之服務範圍詳如附件一，各項分析儀器之功能如附件二「」內容所示。Article1ServicePartyAentrustsPartyBwiththeProject,andthescopeofserviceisspecifiedinAttachment1.Thefunctionsofrespectiveanalyticalins
3、trumentsareshowninAttachment2,“.”第二條執(zhí)行期間本計畫中乙方提供甲方之服務期間自年月日起至年月日止。Article2ProjectDurationTheProjectisimplementedfromto.第三條服務方式一、乙方於本計畫執(zhí)行期間，應提供甲方每週次分析之時段，（本計畫期間扣除歲休及保養(yǎng)乙方應提供共次分析時段之服務）。二、甲方於本計畫執(zhí)行期間得依分析需求選擇服務項目，計劃執(zhí)行期滿，不足之服務次數(shù)，視同甲方自動放棄。但因乙方人員及儀器故障等因素延誤者，不在此限，乙方須完成延誤之服務次數(shù)。三、甲方委託乙方進
4、行分析應遵守相關實驗室管理規(guī)則及儀器管理辦法（如附件三）製備試片、預約時段及進行實驗。四、乙方於計畫執(zhí)行期間僅提供材料分析數(shù)據，不提供試片製備及實驗結果之解析服務。五、本合約所產生之數(shù)據等成果，其智慧財產權仍屬於甲方。Article1ServiceMode1.PartyBshalloffertheanalysisoftimesperweektoPartyA(exceptfortheperiodofyearlymaintenance,PartyBshallofferanalysisservicesintotalwithintheprojectdur
5、ation).2.PartyAmaychooseservicesbasedonitsanalyticalneedswithintheprojectduration,andPartyAwillbedeemedvoluntarilygivingupthenumberofservicesnotrequestedyetupontheexpirationoftheprojectduration.Notwithstandingtheforegoing,PartyBshallmakeupthedifferenceinthenumberofservicespro
6、videdthatthedifferencehasbeencausedbythepersonnelorbrokenequipmentofPartyB.3.WhenPartyBconductstheanalysisofasentrustedbyPartyA,PartyAshallprepareteststrips,makereservations,andconductexperimentswhileabidingbytheapplicablerulesforthemanagementoflaboratoriesandequipment(Attach
7、ment3).4.Duringtheprojectduration,PartyBshallprovideonlymaterialanalysisdata,andwillnotberesponsibleforpreparingteststripsormakingananalysisoftheexperimentresults.5.TheresultsoftheProjectandtheintellectualpropertyrightsthereofshallbelongtoPartyA.第四條服務費用甲方須於計畫執(zhí)行前將本計畫之服務費用總計新臺幣
8、元整(含稅)，以現(xiàn)金或即期支票交付乙方，其細目如附件一計畫書。抬頭寫明「義守大學」，並由乙方開立收據交與甲方。Article2Servi
