1、中文摘要虛擬財(cái)產(chǎn)作為一種新鮮事物，區(qū)別于傳統(tǒng)財(cái)產(chǎn)而具有新的特征。由于目前司法實(shí)踐中侵犯虛擬財(cái)產(chǎn)的案件層出不窮，而且我國立法對(duì)于虛擬財(cái)產(chǎn)的保護(hù)處于空白地帶，為了我國網(wǎng)絡(luò)產(chǎn)業(yè)的健康發(fā)展和公民所擁有的虛擬財(cái)產(chǎn)能夠得到保護(hù)，將虛擬財(cái)產(chǎn)納入到刑法的保護(hù)已經(jīng)勢(shì)在必行。只有這樣才能為處理侵犯虛擬財(cái)產(chǎn)的案件提供立法依據(jù)。本文分為四章對(duì)虛擬財(cái)產(chǎn)的刑法保護(hù)進(jìn)行論述：第一章，主要對(duì)虛擬財(cái)產(chǎn)的概念、特征、內(nèi)涵及外延進(jìn)行了考察和討論，為虛擬財(cái)產(chǎn)下了定義；并且對(duì)虛擬財(cái)產(chǎn)的財(cái)產(chǎn)屬性和法律屬性進(jìn)行了論述，分析學(xué)界的觀點(diǎn)后，得出虛擬財(cái)產(chǎn)具有財(cái)產(chǎn)屬性，應(yīng)受到刑法的保護(hù)；第二章，主要是

2、對(duì)虛擬財(cái)產(chǎn)的國內(nèi)外研究現(xiàn)狀進(jìn)行了論述，域外的立法現(xiàn)狀可以得到借鑒：第三章，主要是對(duì)虛擬財(cái)產(chǎn)刑法保護(hù)的理論依據(jù)進(jìn)行了論述，肯定了虛擬財(cái)產(chǎn)刑法保護(hù)的可能性和必要性；第四章，主要是對(duì)虛擬財(cái)產(chǎn)刑法保護(hù)的一些構(gòu)想的論述，分為立法和司法兩方面的構(gòu)想，希望能為司法工作提供一些幫助。關(guān)鍵詞：虛擬財(cái)產(chǎn)：刑法保護(hù)；財(cái)產(chǎn)屬性AbstractVirtualproperty鷦anewthingdifferent610mthetraditionalpropertywithnewfeatures．Duetothecurrentjudicialpracticeincasesofv
