1、中文摘要網(wǎng)絡(luò)的日益發(fā)展影響著整個(gè)社會(huì)，亦包括對(duì)法律的影響。網(wǎng)絡(luò)輿論是網(wǎng)絡(luò)的附屬物之一，是民主社會(huì)必不可少的產(chǎn)物。網(wǎng)絡(luò)輿論對(duì)司法量刑產(chǎn)生了正反兩方面影響。一方面，網(wǎng)絡(luò)輿論可以監(jiān)督司法、宣傳法治；另一方面，網(wǎng)絡(luò)輿論對(duì)量刑活動(dòng)帶來壓力和負(fù)面影響也日益凸顯。如何因勢利導(dǎo)讓網(wǎng)絡(luò)輿論為司法服務(wù)，同時(shí)避免出現(xiàn)輿論審判，使網(wǎng)絡(luò)輿論與司法活動(dòng)實(shí)現(xiàn)良好的互動(dòng)，促進(jìn)二者共同和諧發(fā)展，這一現(xiàn)實(shí)問題應(yīng)引起網(wǎng)絡(luò)媒體、司法部門的足夠重視。本文由李昌奎案引出網(wǎng)絡(luò)輿論影響量刑的問題，綜合闡述了網(wǎng)絡(luò)輿論對(duì)司法量刑的積極影響和消極影響，再進(jìn)一步對(duì)網(wǎng)絡(luò)輿論影響量刑的原因進(jìn)行了理性分析，最后提出了如何充分發(fā)揮網(wǎng)絡(luò)輿
