2、業(yè)歧視的相關(guān)概念及內(nèi)涵,圍繞就業(yè)歧視所帶來的社會問題做了相應(yīng)的分析。我國日前反就業(yè)歧視立法尚不完善,理論研究也不夠充分,本文在對就業(yè)歧視概念界定的基礎(chǔ)上,探討了中國目前的就業(yè)歧視法律制度存在的不足,提出了個人對完善就業(yè)歧視法律制度的建議。本文系運用規(guī)范研究方法進(jìn)行的專題研究。全文分4個部分:首先是討論了就業(yè)歧視的概念及其表現(xiàn)形式以及市場經(jīng)濟中的差別對待是否等同于就業(yè)歧視;其次是從經(jīng)濟法的角度對就業(yè)歧視問題所體現(xiàn)出的市場調(diào)節(jié)失靈和政府管制缺陷的兩難境地進(jìn)行了分析,同時對如何運用經(jīng)濟法這一解決機制來解決就業(yè)歧視問題進(jìn)行了分析;最后結(jié)合美國反歧視法
