1、內(nèi)容摘要改革開放以來(lái)，我國(guó)一方面在經(jīng)濟(jì)建設(shè)上取得了巨大成就，但另一方面，建筑類文化遺產(chǎn)也遭NT嚴(yán)重的破壞，尤其是在當(dāng)前的城市化進(jìn)程中，建筑類文化遺產(chǎn)的保護(hù)問(wèn)題，更是面臨著嚴(yán)峻的挑戰(zhàn)。但我國(guó)目前的建筑類文化遺產(chǎn)法律保護(hù)制度還不完善，有關(guān)的理論研究也尚欠深入，因此對(duì)建筑類文化遺產(chǎn)的法律保護(hù)問(wèn)題進(jìn)行全面的分析和研究，非常必要。人類的生存環(huán)境包括自然環(huán)境與人為環(huán)境，建筑類文化遺產(chǎn)屬于人為環(huán)境的范疇，是環(huán)境的構(gòu)成要素之一，但目前環(huán)境法對(duì)于人為環(huán)境還沒有做出明確的晃定。因此本文首先從環(huán)境法對(duì)人為環(huán)境的界定作為問(wèn)題的切入點(diǎn)，分析當(dāng)前環(huán)境法對(duì)人為環(huán)境難以界定的原因，并試用調(diào)整論
2、和生態(tài)學(xué)的觀點(diǎn)，探討環(huán)境法界定人為環(huán)境的可能性，明確必須在法律上賦予人為環(huán)境以生態(tài)環(huán)境地位，才能對(duì)人為環(huán)境要素實(shí)旌有效的環(huán)境法保護(hù)。然后將建筑類文化遺產(chǎn)放到人為環(huán)境中進(jìn)行考察，回歸其生態(tài)環(huán)境的本質(zhì)，分析其所具有的包括生態(tài)價(jià)值在內(nèi)的價(jià)值屬性。最后回到建筑類文化遺產(chǎn)的法律保護(hù)問(wèn)題上來(lái)，先介紹國(guó)際保護(hù)的經(jīng)驗(yàn)，以及由此給我們帶來(lái)的啟示，再評(píng)述我國(guó)的建筑類文化遺產(chǎn)保護(hù)制度，并對(duì)制度的迸一步完善提出了自己的幾點(diǎn)思考。關(guān)鍵詞：建筑類文化遺產(chǎn)人為環(huán)境法律保護(hù)AbstractAsthereformandopeningtotheoutsideworld,Chinahasontheo
