2、tothetransaction,awareoftheneedtomakeinternationalfinancialleasingmoreavailable,consciousofthefactthattherulesoflawgoverningthetraditionalcontractofhireneedtobeadaptedtothedistinctivetriangularrelationshipcreatedbythefinancialleasingtransaction,recognizingthereforethedesirabilityofformula
3、tingcertainuniformrulesrelatingprimarilytothecivilandcommerciallawaspectsofinternationalfinancialleasing,haveagreedasfollows:本公約各當(dāng)事國，認(rèn)識(shí)到在保持國際融資租賃交易各方的公正平衡的同時(shí)，消除對(duì)設(shè)備國際融資租賃的某些法律障礙的重要性，意識(shí)到使國際融資租賃得以更多地使用的需要，意識(shí)到管轄著傳統(tǒng)的租借合同的那些法規(guī)需要適應(yīng)于融資租賃交易所造成的特有的三邊關(guān)系這一事實(shí)，因而認(rèn)識(shí)到有必要制訂出某些主要與國際融資租賃的民法和商法方面有關(guān)的統(tǒng)一規(guī)則，茲協(xié)議如

5、rwhichthelessoracquiresplants,capitalgoodsorotherequipment(theequipment)ontermsapprovedbythelesseesofarastheyconcernitsinterests,andb.entersintoanagreement(theleasingagreement)withthelessee,grantingtothelesseetherighttousetheequipmentinreturnforpaymentofrentals.2.Thefinancialleasingtransa
6、ctionreferredtothepreviousparagraphisatransactionwhichincludesthefollowingcharacteristics:a.thelesseespecifiestheequipmentandselectsthesupplierwithoutrelyingprimarilyontheskillandthejudgmentofthelessors;b.theequipmentisacquiredbythelessorinconnectionwithaleasingagreementwhich,totheknowled
