1、DIGITALLICENCEAGREEMENTSANDITSEFFECTSONACADEMICLIBRARYUSERSIntroductionLicenceagreementsarelegalagreementsbetweenthesuppliersofdigitaldatabasesandusersthathaveconditionsonuseofthedatabases(Keenan,etal.,2000:154).Theseagreementsareaconsequenceofthebirthofdigitalinform
2、ation.Someoftheselicencesimpliedlyincludethefairdealingexemptionthatwascoinedforprintinformation.Thisfairdealingexemptionallowsscholarstocopyanduseprintedworks,whichhavenotgoneintothepublicdomainwithoutbeingchargedofcopyrightinfringement.Theinclusionoftheprintfairdea
3、lingexemptionindigitalinformationisendorsedbylegislativedigitalactsenactedbycertaincountriesandbylibrarieswhosecommonpracticeistotransfertheexemptiontothedigitalenvironment.Theaimofthispaperistotestwhetherthegloballyacceptedassumptionsthattheprintfairdealingexemption
4、isappropriateinthedigitalenvironment.Inordertotestthisassumption,thispaperfirstexaminestheoriginofprintmediacopyrightlawandthefairdealingexemptions.Secondly,thepaperunveilshowpublishershaverecentlyintroducedaccesslicencestogoverndigitalinformation.Theconsequencesofin
5、appropriatelyincludingthefairdealingexemptioninthedigitalenvironmentarerevealed.Finally,thepaperattemptstoproposechangesinlicensingagreementsinordertoaccommodatetheexemptioninthedigitalrealm.CruxofprintmediacopyrightlawPriortotheemergenceofdigitalinformation,copyrigh
6、tlawgovernedthereproductionorcopyingofprintedinformation.Theappearanceofthefirstcopyrightlawin1710wastheupshotofagitationsfromreligious,ideological,andprovincialprintersresultingfromthesocial,political,andeconomicupheavalsinEnglandatthetime.Thesegroupswereagitatingag
7、ainstthereactionoftheCrowntohaveallprintedworkscontrolledandmonopolizedbytheStationersCompany–aLondonbasedtradeguild(Mergesetal.,2000:345-346).WhenthefirstCopyrightLawwaspromulgatedin1710,itsobjectivewastoencouragelearnedmentocomposeandwriteusefulbooks(Phillipsetal.,
