4、ngregardtotheTreatyestablishingtheEuropeanCommunity,andinparticularArticle95thereof,HavingregardtotheproposalfromtheCommission(1),HavingregardtotheopinionoftheEconomicandSocialCommittee(2),ActinginaccordancewiththeprocedurelaiddowninArticle251oftheTreaty(3),inthelightofthejointtextapprovedbyt
5、heConciliationCommitteeon25June2001,Whereas:(1)Theinternalmarketcomprisesanareawithoutinternalfrontiers,inwhichthefreemovementofgoods,persons,servicesandcapitalisensured.Itisimportanttoadoptmeasurestothatend.(2)Thetechnicalrequirementswhichmotorvehiclesmustsatisfypursuanttonationallawsrelate,
6、interalia,tospecialprovisionsforvehiclesusedforthecarriageofpassengerscomprisingmorethaneightseatsinadditiontothedriver'sseat.(3)ThoserequirementsdifferfromoneMemberStatetoanother.(4)Owingtodifferencesintechnicalprescriptions,thesevehicleshavebeenpreventedfrombeingputontotheCommunitymarket.Th
