1、勞動報酬權(quán)論文：論勞動報酬權(quán)的法律保護【中文摘要】勞動報酬權(quán)是公民的一項基本人權(quán)和財產(chǎn)權(quán),歷來受到我國政府的高度保護。尤其是進入二十一世紀,隨著經(jīng)濟快速增長,科學(xué)發(fā)展觀、和諧社會建設(shè)的提出和人權(quán)入憲,將我國勞動報酬權(quán)的法律保護推升到一個嶄新的高度。面對社會經(jīng)濟發(fā)展和國家政策的要求,當前我國勞動報酬權(quán)保護現(xiàn)實與需求之間差距越拉越大的,在時代呼喚下,國家加大了勞動報酬權(quán)的保護,制定了《勞動合同法》,并針對拒不支付勞動報酬行為規(guī)定了拒不支付勞動報酬罪。本文以拒不支付勞動報酬入刑為視角,剖析了勞動報酬權(quán)的內(nèi)涵、該罪的時代背景,分析

2、了本罪得以成立的法理依據(jù),認為拒不支付勞動報酬行為危害了國家對勞動報酬權(quán)的保護制度,誘發(fā)了一系列不穩(wěn)定不和諧的社會問題,促使社會反思勞動報酬權(quán)法律保護缺位對遏制拒不支付勞動報酬的影響。立法機關(guān)順應(yīng)歷史和民意,增設(shè)拒不支付勞動報酬罪,使國家保護勞動報酬權(quán)特別是弱勢農(nóng)民工報酬權(quán)、懲治拒不支付勞動報酬,有了更完備的法律制度。同時應(yīng)正確認識到,國家工作重點應(yīng)繼續(xù)放在治理上。對此,法律應(yīng)當發(fā)揮作用,注重發(fā)揮刑事、民事、行政和民間調(diào)解的整體合力,既要考慮對勞動者特別是農(nóng)民工的人性關(guān)懷,又要給企業(yè)以喘息的機會,在兩者利益保護中把握平衡點
