2、貸款目的與貸款手段雙重規(guī)制的立法模式，有其創(chuàng)新和突破。但在司法實踐中，對騙取貸款行為的打擊力度和司法認定方面又稍顯不足，本文將以現(xiàn)行法律和法規(guī)為基礎，結合騙取貸款罪的立法意義，具體分析騙取貸款的認定問題，以適應當前的經(jīng)濟發(fā)展和法治要求。本文從三個方面圍繞騙取貸款罪的認定進行論證，即騙取貸款罪的內涵、騙取貸款罪的構成、騙取貸款罪與其他罪界限。第一部分騙取貸款罪的內涵，本罪的含義和騙取貸款罪的立法沿革，其中重點講述的是騙取貸款罪的立法意義；第二部分騙取貸款罪的構成，重點騙取貸款罪客觀方面進行論述，如欺騙的手段、銀行及金融機構和貸款三個方面對本罪進行論證，對“重
