1、論刑事非法證據(jù)的效力OnTheeffectivenessofCriminalillegalevidenceAbstract論刑事非法證據(jù)的效力中文摘要目前對(duì)于非法證據(jù)存在價(jià)值的取舍，在法律適用上與法律禁止違法精神產(chǎn)生了不可調(diào)和的矛盾。實(shí)踐中合法的證據(jù)不一定是真實(shí)的，不合法的證據(jù)不一定就是偽造的。如用威脅，引誘手段獲取的口供不一定完全是虛假供述，只是增大了這種可能性。刑事非法證據(jù)因?yàn)槠渚哂蟹欠ǖ囊蛩兀蚨滑F(xiàn)代法制所難接受：一是違法收取證據(jù)是違反我國憲法的行為；二是違法獲取的證據(jù)具有證據(jù)效力是造成冤假錯(cuò)案的直接原因；三非法取得的證據(jù)具有證據(jù)效
